How to Propose Orders

Proposed orders must be submitted through CM/ECF. This page outlines basic order formatting requirements, the initial submission process, and the process for amending a proposed order.

Formatting Requirements

Local Bankruptcy Rule 9072-1 outlines the requirements for proposing orders to the Court. Among those requirements: 

  • The first page of the proposed order must include a 4" top margin. This will accommodate the Judge's electronic signature.
  • The proposed order must include a caption including the name of the debtor, the case number, the chapter under which the case if filed, the adversary proceeding number, if any, and the name of the Judge to whom the case is assigned.
  • The caption must contain a statement of the nature of the order and the relief proposed to be granted.
  • The proposed order must clearly identify the filed documents to which it relates by reference to the docket number. 
  • The phrase "SO ORDERED" must appear at the end of the proposed order (even if it is an agreed order).
  • The proposed order must include a service list of parties to receive a copy of the order.

Submission in CM/ECF

To submit a proposed order in CM/ECF, take the following steps.

  1. Select Order Upload in the Bankruptcy or Adversary menu.
  2. Select Single Order Upload.
  3. Enter the case number and, if known, related document number when prompted. If you do knot know the related document number, leave that prompt blank and you will be prompted to select the related document from the docket sheet.
  4. The order upload screen will display. Take the following actions.
    • Confirm that the case number and related document number are correctly displayed.
    • Select the appropriate order type (expedited, agreed, or other).
    • Indicate whether the matter will be or has been heard.
    • Upload the PDF.

A confirmation screen will be displayed upon successful submission.

Replacements and Additional Orders

In some instances a proposed order may need to be replaced, or a second order may be necessary. The process of replacing an order is the same as uploading the order as previously described. However, after selecting the related document, you will have the option to propose a new order or replace the existing proposed order. (The original order cannot be replaced if it has already been routed to the Judge. In such instances, contact the Court for assistance.) Note that you cannot replace an order uploaded by a different filer. A confirmation screen will be displayed upon successful submission.
