Mortgage Modification Mediation Program

The Mortgage Modification Mediation (“MMM”) Program acts as a forum for debtors and creditors to reach a consensual resolution when a debtor’s property is at risk of foreclosure or other adverse action. The goal of MMM is to facilitate communication and exchange of information in a confidential setting and encourage the parties to finalize a feasible and beneficial agreement under the supervision of the Court. The MMM Program is optional, and debtors may continue to apply for loan modifications under other loss mitigation programs.

A motion for referral to the MMM Program can be filed after the case is commenced and once the following steps are complete:

  1. Pay the bankruptcy filing fee in full.
  2. Prepare the Certification of Mortgage Modification Mediation Eligibility and Readiness.
  3. Complete the Document Preparation Software (DPS) requirements, including paying the fee and obtaining the Certificate of Document Preparation.
  4. Complete the initial MMM Package.
  5. Include the Non-Standard Provision in Paragraph 13 of your Chapter 13 Plan (if applicable).

Facilitators

The Court maintains a list of facilitators. The parties may choose to appoint a facilitator to assist in the MMM process, however a facilitator is not required to proceed with the MMM process.

If you would like to apply to be listed on the facilitator list please submit an application. Any Ohio licensed attorney who has been admitted to practice before this Court for a minimum of five years, and who has completed portal training and a minimum of eight hours of specific MMM training, may apply to become a facilitator.
