Objections and Other Responses
Generic Objections and Responses
To file a response to a motion or application in a bankruptcy case, select Answer/Response in the Bankruptcy menu of CM/ECF and select Reference an Existing Motion/Application. CM/ECF will prompt you for the case number and then ask whether your filing is an objection, response, or reply to a response/objection. Select the appropriate event, select the motion or application to which your filing relates, and upload your PDF.
Specific Objections
Certain filings have specific objection events in CM/ECF that should be utilized when appropriate. For example, in the Other menu in CM/ECF, you will be presented with certain specific objections, including:
- Objection to Debtor's Claim of Exemptions
- Objection to Homestead Exemption
- Objection to Valuation
In the Plan menu in CM/ECF, you can find the Objection to Confirmation of Plan event. Other examples can be located using the Search feature in CM/ECF. Be sure to review the available CM/ECF events if you are unsure whether a specific objection event applies to your filing.
Answering an Adversary Complaint
To file an answer in an adversary proceeding, select Answers... in the Advesary menu of CM/ECF. You will be prompted to indicate whether the answer is made in response to a motion/application filed in the adversary proceeding or in response to the complaint, third-party complaint, cross-claim, or counter-claim.
To file an answer to a complaint, select complaint and then enter the case number. You will be asked to select the party; select the defendant(s) for whom the answer is being filed and then confirm that you are representing that defendant (creating an "attorney/party association").
CM/ECF will allow you to link the answer to the complaint, prompt you for the PDF document, and then ask whether the filing includes a third-party complaint, cross-claim, or counterclaim. (If you indicate this, the system will ask you to enter information regarding the new claimant.) Finally, verify the docket text and submit the filing.
