Emergency Filings: Non-Electronic Filers

Filers may utilize the Court’s emergency filing procedure if they are in danger of missing a filing deadline.

When is it an Emergency?

If you do not have electronic filing privileges and are in danger of missing a filing deadline, the emergency procedures may be utilized if either of the following are true:

  • The Clerk's Office was open but has closed for the day (e.g., it is after 4 p.m. or the Clerk's Office has closed unexpectedly).
  • The Clerk's Office is closed for the weekend or a holiday.

How to Submit Your Filing

Emergency filings may be submitted to the Clerk’s Office by filling out the emergency filing form and uploading the filing in PDF format. You will be asked to state the reason the alternate filing method is being utilized and the filing deadline. You will receive a confirmation of submission. After submission you must deliver the complete original document with any required fee to the Clerk’s Office no later than 4:00 p.m. local time on the Court’s next business day. At that time, present a copy of the confirmation e-mail showing the document was submitted the previous day. It is not the responsibility of the Clerk’s Office staff to make this association. Original documents received after 4:00 p.m. the next business day will be filed as of the date and time they were physically received by the Clerk’s Office staff.

Receipt by the Clerk's Office

Upon receipt of the document, if the procedures outlined above have been followed, the Clerk’s Office staff will docket the document with the following notation: “This document is deemed filed on ________ (date/time) pursuant to the Court’s Emergency Filing Procedures.” If the document was submitted electronically, it will be deemed filed on the date and time appearing on the email system of the Clerk’s Office.
